Wow, ATF’s Pistol Brace Rule Blocked By Federal Appeals Court, Issued Temporary Injunction

The 5th Circuit Court of Appeals has just granted an injunction against the ATF's pistol brace rule in the case of Mock v. Garland.

For those who are unfamiliar, the 5th Circuit of Appeals covers Louisiana, Mississippi, and Texas. They play a crucial role in the judicial system, reviewing appeals from lower courts to ensure the fair and correct application of the law.

Their decisions have significant ripple effects, shaping how the law is interpreted and enforced within their jurisdiction.

However, it is not clear whether this injunction applies only to the plaintiffs or also to the people within the jurisdiction of the 5th Circuit Court or anyone who owns a Maxim Defense firearm with a brace and members of FPC.

It is also unclear whether the injunction applies nationally.

Currently, the ATF rule requires anyone who owns a gun with a pistol brace to either remove and destroy it or register the braced firearm with the ATF and pay a tax before May 31.

Failure to comply with this requirement could technically result in a felony charge and potential arrest.

However, this injunction prevents the ATF from arresting people until the appeals court makes a ruling on the rule, regardless of whether it is before or after May 31.

In short, as long as this case is ongoing, the ATF cannot enforce their brace rule. The exact scope of the injunction and who is covered by it is still uncertain.

The Firearm Policy Coalition has already requested clarification on the injunction to determine who is covered by it.

The senior attorney for Constitutional Litigation at FPC stated, "We intend to ask the Court for additional information about who is covered under the injunction, but cannot stress enough just how important this decision is.

The fight is far from over, but this is a huge victory in the battle against the ATF's unconstitutional and unlawful brace rule!"

The ATF's pistol brace rule, in my opinion, is pure insanity.

The ATF, which is supposed to enforce laws, is essentially creating a law with this rule.

Furthermore, the ATF previously stated that pistol braces were legal for years and then changed their position after millions of people had already purchased firearms with braces.

If the ATF rule is upheld, millions of people could potentially become felons simply because of a piece of plastic designed to assist the disabled in exercising their Second Amendment rights.

This is a clear infringement on those rights.
